Get a moto friendly cop to sign off on the inspection form, and have him/her or check the emissions box (the correct one, CA) yourself with the same pen. Do not bring the bike to dmv. Just bring all the appropriate paper work. DMV does not have to inspect the bike if all of the paper work is properly done. If they still hassle you, have a dmv contracter agent (that is what I used) do it for you. Cost me about $30, but it was hassle free. FYI, your bike does not have the appropriate level of emissions spec to properly/legally qualify for the emissions standard they are requiring anyways.

Sorry but I don't think you will be able to plate your bike. In order to be road licensed your bike must have a street emissions sticker. If your Berg did in fact come with a sticker it was only off road emissions legal. There is a difference. Technically there is no way an off road emissions legal bike can be road registered as of January 1, 2004. The rules were changed. DMV doesn't know some of there own rules so some sneak through.

The California Air Resources Board (ARB) established emission regulations for on-highway motorcycles beginning with 1978-year models. Off-highway motorcycles must have an emission label affixed to the vehicle indicating certification by the manufacturer for on-highway use when converting to on-highway or dual registration. Registration guidelines for off-highway motorcycles converting to on-highway or dual registration require verification of the emission label.

Off-highway motorcycles previously converted to on-highway or dual registration will not be subject to verification. Off-highway motorcycles year model 2003 and newer with a red sticker will not be allowed to convert.

NOTE: ATV OHVs cannot be originally registered for on highway use or converted to on-highway registration, regardless of aftermarket conversion kits or added equipment.

Please direct questions regarding emission certification or labeling to the California Air Resources Board at 1-800-242-4450 or visit their website at www.arb.ca.gov.

:D awesome thanks for all the replies ...im gonna stay optimistic on this one and hit it fup full throttle! ill let u guys know what happens here in the end ... untill then thanks again!

BTW: Don't bother calling CARB. My buddy had a plate revoked on his 2004 Husky 510 and when he called for clarification they were not really friendly. He also indicated that they are even dumber than DMV. So there is someone more ignorant than a CA DMV worker.
