Need assistance - Warranty contact.

I started a thread to get info. on my primary drive gear breaking. It's turned into a long and painful issue.
By berg is supposed to have a warranty.
My dealer has tried to work things out with the warranty company but the bottom line is that the warranty company informed me and my dealer that Husaberg has not paid them for the warranty so they can not pay my dealer.

My dealer Long's Motorcycle Sales has bent over backwards to assist me with this. He bought all the parts and fix the bike.

Who can I call?? What is my next step? I want my Berg back and I can't afford to pay $2500.

as much as a hate a litigious society my suggestion is this- (i am unsure if there was some agreement that is in the paperwork about a third party arbitration, there probably is, but a post on a few sites may turn up a lawyer who can answer your questions)

If you really feel that you have exhausted all options for civil resolution tell them that you want them to honor their agreement or you will take them to small claims court, take the original letter approving the work and the original documentation regarding the warranty from when you purchased the bike.

from what I understand- 1.you paid for a warranty, 2. this is covered loss 3. you got approval prior to performing work.

the error lies somewhere between Husaberg proper and the warranty company. true? if so, this is not your problem and I would make damn sure they that they know you are not going to take it in the rear because they screwed up.

i know it seems like a pain in the butt, but spend $50 and file and send a copy to them. see what they do....

Judgments are usually found against parties that are "no -shows"

it may take a while but at least you would have a chance to recoup your losses.
 
Good luck on this one RR618, we are watching this one closely. Hopefully it is just paperwork that dropped through the crack...did the warranty company give you an contact name at Dixie ?

BMXR did get me a bunch of information. I left a message last Thursday. No call as of yet.

Waiting.

Not telling you what to do but the warranty people should be able to tell you the exact person you should call at Dixie
 
I used to know who to talk to and he helped me with my problem that was almost the same as yours . Unfourtunately he is no longer employed by BMG.

Did you buy the extended warranty?

I may be able to see through some of the cracks.

Hey Boss,

I bought my Berg on 11/06.
When I purchased it was my understanding that it had a 1 year warranty.
Am I wrong?
The warranty company explained to me that they had not been paid for the warranty by Husaberg. Not trying to bad mouth anyone just trying to get things resolved.

hey road racer, what year is your bike? from my understanding the warranty is not automatic. BOSS obviously knows for sure, but my understanding is that the warranty comes with a price tacked onto the bike, like $200 or something. either you paid it or the dealer paid it. You should have it documented somewhere on an sale invoice or something. if it was agreed that the dealer was to pay it out of the sale proceeds you need to have him produce something that states it was paid for. if you paid the dealer for the warranty during the transaction you need to find out what happened to the money...

Have you seen paper work with your bikes VIN stating that it is covered ? you need to make sure you actually have one. I don't believe verbal statements by the dealer "it has a warranty" but not having proof it was actually paid for will get you anywhere with the warranty company.

When I gave the deposit on my bike I was given a Bill of Sale with the total for the bike including freight and extended warranty. I had to dig up my paperwork to verify. But I did clearly pay for the extended warranty. In addition after I took the bike out of the dealer it had the VIN# written on the sale papers.

UPDATE:

First I would like to say that at no time did I intend to make this a "negative" thread. I needed information and assistance and I truly did not mean to make this a into any type of pointing fingers or bashing anyone.
I love my Berg and I intend to keep it. I want to buy a 550 for my son as soon as I can get rid of our CRF450R. My dealer and all the players have treated very well and have push to assist me in any way that they can.
So I apologize if I came off in the wrong way.

In addition, I want to say thanks to BOSS. He went out of his way to contact the correct people to dig up information for me and he gave me an update.

My bike and my name are in the system and unfortunately the person that handles this is on vacation (just my luck). Things will be moving forward I hope by the 22nd.

More to come as soon as I know.

Tony, At no time in this thread did you "sound" negative to me. It looks as you have stated, you were looking for help and some direction and have reported back your progress. The Berg-Basho-Meter says......................... No Bashing detected . Good luck hope all is well in the end.

I had some problem with my fe 450 ´05 (a bearing broke in the motor) my dealer here in Iceland took the bike and offerd my a new one ´07 whith 15% dicount. no questions askt. so now i am riding a new bike.

Well I plan on getting a 550 for my son. 15% discount would be killer. I'll take it.
 
Ok All,

Lastest update. I went to my dealer on Saturday May 26 and picked up my bike. He is still working out the details for the warranty but it's rolling in the correct direction.
My dealer Long's Motorcycle Sales - Longevity Racing - did not ask me for a penny to take my bike home. He explained to me that the warranty does not cover consumables but he will work that out with me later once he has all the info in his hands.
John has treated very well and has been more than fair with me.

Picked up the bike on Saturday went to the CCS races on Sunday and Monday.

Bought home a 2nd place in the ULWSB class and a fourth place in the LWF40 class (yes, I'm old).

The bike ran awesome. If it had a good rider instead of an old tired guy that second place would be a first.

Thanks for the assistance from Boss and the others that gave me advice and input.
